Milton enacts 30-day land disturbance moratorium

Council action comes in response to proposed commercial property



MILTON, Ga. — The Milton City Council has approved a 30-day land disturbance moratorium on properties that border Alpharetta in the city’s Crabapple district.

The moratorium, passed at a special called meeting June 21, stemmed from Alpharetta residents’ concerns over a request to build two properties at 12455 Broadwell Road, zoned T4 and T2, which designates a mix of residential and commercial properties. The larger building, a 10,000-square-foot facility, would be used as a recreation space and fitness studio. The other building, a 7,500-square-foot structure, would be for retail space with three apartments on the second level.

The complex shares its southern border with Alpharetta and single family homes. An Alpharetta resident, whose home would share a border with the proposed complex, voiced grievances over a lack of buffer between the site and his home.

But under the current Crabapple form-based code, the complex is not required to have a buffer.

Kathy Field, Milton Community Development director, told council members that under the Crabapple form-based code, buffers inhibit walkability, which was the aim of the code when it was adopted in 2011.

After some confusion over whether the moratorium would affect all of the Crabapple District or just outlying parcels, council members voted 4-0 in favor of the moratorium, with Mayor Joe Lockwood and councilmembers Rick Mohrig and Burt Hewitt absent. ‘

City staff identified three other parcels that border Alpharetta the moratorium – and any subsequent changes to the form-based code – could affect. Those parcels include: 12595 Crabapple Road next to Cans Taqueria; 875 Mayfield Road, which contains the stone house next to the Milton library; and a parcel along Arnold Mill Road behind the Kroger shopping center.

The Broadwell Road parcel which sparked consideration of the moratorium will not be affected because the city cannot retroactively enforce any potential changes to the form-based code.
